If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party. We will determine, in our discretion, whether there has been a breach of this acceptable use policy through your use of our site.  When a breach of this policy has occurred, we may take such action as we deem appropriate.

Failure to comply with this acceptable use policy constitutes a material breach of the terms of use above upon which you are permitted to use our site, and may result in our taking all or any of the following actions:

  1. Immediate, temporary or permanent withdrawal of your right to use our site.
  2. Immediate, temporary or permanent removal of any posting or material uploaded by you to our site.
  3. Issue of a warning to you.
  4. Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.
  5. Further legal action against you.
  6. Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

We exclude liability for actions taken in response to breaches of this acceptable use policy. The responses described in this policy are not limited, and we may take any other action we reasonably deem appropriate.

  1. Jurisdiction and applicable law

The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to our site.

These terms of use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.

We may revise the (i) terms and conditions of use or (ii) acceptable use policy at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we made, as they are binding on you. Some of the provisions contained in these terms of use may also be superseded by provisions or notices published elsewhere on our site.

  1. Payments

If the Member elects to pay by monthly, the Member authorises the Company to charge the Member’s credit card or debit card. 

If the Member elects to pay in FULL, the Member may pay by credit card, debit card or bank transfer.

We do not collect or store your full credit card information when you make a payment online. All credit card transactions are processed securely through PayPal and or Stripe, and at no point does Tamsin Acheson Coaching & Consulting have any access to your full credit card number, payment platform profile or security code whatsoever. Your card information is completely secure and protected by PayPal and or Stripe.

Ad Hoc Consulting Sessions – 60 minutes, 3 Hours & 6 Hours – are to be paid in full within 48 hours of booking in order to secure the appointment.

Annual Consulting Packages – 3 Hours, 6 Hours & 12 Hours – the first payment plan installment is to be made at point of contract to secure the consulting space place and rate. This installment will act as a non- refundable deposit. A further 3 installments will be paid in advance of each session. The final session will only be delivered once full payment has been made and the account has been settled.

3 month leadership course is to be paid in full at point of purchase in order to secure the course place.

12 month leadership course is to be paid in full at point of purchase. If a payment plan is required then a 25% deposit of the full course price is due at point of purchase to secure the course place. If a payment plan is selected 3 further payments will be required (May/Sept/Jan).

1:1 leadership coaching is to be paid in full at the point of purchase. If a payment plan is required then a 25% deposit of the full course price is due at point of purchase to secure the coaching place. If a payment plan is selected 3 further payments will be required. 

  1. Refunds/Returns

Returns are rare, but here are our policies:

Digital Information cannot be “returned.” Tamsin Acheson Coaching & Consulting has a “No Refund” Policy for all digital download products purchased directly.

Deposits are non-refundable on all applicable products and services.

Ad Hoc Consulting Sessions – 60 minutes, 3 Hours & 6 Hours – have 7-day cancellation grace periods. A full refund will be issued if cancelled within this period. Sessions cancelled between 72 hours and 6 days are eligible for a 50% refund. If the session is cancelled up to 72 hours before the appointment the entire fee will be forfeited and no refund will be owing.

Annual Consulting Packages – 3 Hours, 6 Hours & 12 Hours – the first payment plan installment is considered a non-refundable deposit. The annual consulting package may be cancelled up to the point of service delivery. Once the first session is delivered the contract and payment plan are deemed active and the full payment of the fees for the annual package is mandated, regardless of whether the client participate further in the service/product/package.

You must attend weeks 1, 2, 3 and the group call as well as send evidence of completed worksheets to qualify for this refund.

Any refund will be processed within 28 days of confirmation of refund.

1:1 Leadership Coaching 12 Session contract – the first payment plan installment is considered a non-refundable deposit. The contract may be cancelled up to the point of service delivery. Once the first session is delivered the contract and payment plan are deemed active and the full payment of the fees for the contract is mandated, regardless of whether the client participate further in the service/product/package. After 6 hours there will be the opportunity to review the arrangement and if deemed mutually beneficial the contract may be settled based on hours delivered (at full hourly rate) and prematurely terminated.

These terms and conditions govern the membership of the Behind-the-Scenes Success Community (“the Community Membership”). All services provided as part of the Community Membership will be subject to these terms and conditions and you are deemed to have accepted them when you purchase the Community Membership unless we expressly agree in writing otherwise. 

Our Privacy Notice which can be found at www.tamsinacheson.com and these terms and conditions represent the entire agreement between us and apply to the exclusion of any other terms. Ensure that you read both these terms and the Privacy Notice. The Privacy Notice sets out how we are obliged to deal with your personal data.

By purchasing the Community Membership you acknowledge and accept that you are purchasing the membership in a business capacity, for business purposes.

The information you provide when purchasing access to the Club Membership must be true and accurate and by applying you are confirming that you are over 18 years of age.

When we accept your application, and upon cleared payment of the Membership Fee, you will become a Member (“Member”). The decision to accept you as a Member is at our absolute discretion. We reserve the right to terminate your Community Membership where we deem it necessary for the safety, protection and benefit of other Members. In the event such a situation arises we do not need to provide a reason for the cancellation and any refund will be considered at our absolute discretion.

In the event an unforeseen or unexpected event arises which prevents us from delivering the Community Membership then you shall be notified by email. We shall not be liable to you for any failure or delay in delivery of the Community Membership or your failure to access the Community Membership or any associated private area or group. In the event an unforeseen or unexpected event arises which continues for a period in excess of 90 days then either of us will be entitled to terminate or cancel this Agreement.

The services provided as part of the Community Membership are as set out in the prospectus.

Access to the Club Membership services and any private areas or groups is online only and no alternative will be provided. It is your responsibility to ensure that you have in place the necessary requirements to allow you to access and use the Community Membership. We shall not be liable to you in the event you are unable to access the Community Membership, any Community Membership services and/or any private areas or groups.

As part of the Community Membership we may provide you with materials, information, data and other content (“Content”). By becoming a Member, you agree and accept that all such Content remains our confidential and proprietary intellectual property and belongs solely and exclusively to us and can only be used by you in connection with your Community Membership and should not be copied, disclosed, or used for any commercial reasons without our express consent.

We shall grant to you a personal, limited, non-transferable, revocable license to access and use any materials and resources provided as part of the Community Membership solely for your personal use and for the purposes intended by these terms and conditions.

Whereas part of the Community Membership we offer interactive or live sessions, 1:1 sessions, group sessions, masterclasses, workshops, masterminds and meet-ups (“Sessions”), the dates and times of these Sessions will be arranged by us and notified to you by email. It shall be your responsibility to attend the Sessions as arranged and no alternative or replacement dates or times shall be offered if you are unable to attend for whatever reason.

As part of the Community Membership you will have access to a private website area. To gain access to this private area you will be required to set up an account and it shall be your responsibility to provide the correct information to create your account and to keep your password or any other access information private, safe and secure. You are responsible for notifying us should you become aware of, or suspect, that a third party is aware of your password or access details.

The Community Membership is provided on an ‘as-is’ and ‘as available’ basis. From time to time we may be required to undertake changes to the Community Membership or our systems and processes, which may includes routine or unexpected maintenance. We shall not be liable for any lack of accessibility to the Community Membership website or any associated groups or systems which is caused due to routine or unexpected maintenance.

The Company, from time-to-time, provides various courses, programs, and associated material for sale separately to the membership. By purchasing these products you are given immediate lifetime access to all the content for our courses, programs, and associated material (collectively the “Courses”) for your own personal or internal business use. Except as otherwise provided, you acknowledge and agree that you have no right to modify, edit, copy, reproduce, create derivative works of, reverse engineer, alter, enhance or in any way exploit any of the Courses in any manner.

By ordering our Courses, you agree that the Courses you purchase or download may only be used by you for your personal or business use and may not be sold or redistributed without the express written consent of the Company. You shall not create any derivative work based upon the Courses and you shall not offer any competing products or services based upon any information contained in the Courses. Not following the above shall be a breach of these terms and conditions.

No refunds are given for a Course you have ordered as you shall be immediately granted instant lifetime access to the course materials and we cannot reverse this access. We clearly lay out what you will be getting from a particular course on the sales page before purchase, this will give you a full understanding of what to expect within the course. The Agreement between us will commence when you purchase access to the Community Membership and shall continue until it is terminated in accordance with these terms and conditions.

If your membership period is three months, it will begin the day after the Membership Fee is paid (“the Membership Period”) and will continue for 90 days thereafter. It will automatically terminate unless you provide us with a request in writing to continue; at which point further payment will be due. Should you wish to terminate within the 90 day period there will be no refund applicable.

If your membership period is twelve months, it will begin the day after the Membership Fee is paid (“the Membership Period”). You may cancel your membership for a full refund within your first 30 days of signing up to the annual membership. To qualify for this refund there either needs to be absolutely no engagement or attendance at all; or you must have attended all 4 main activities delivered in the first month as well as send evidence of completed worksheets.

Refund requests will only be reviewed once all evidence is submitted. Evidence needs to be submitted within the 30-day cut off point and any request after this time will not be considered.

Any refund will be processed within 28 days of confirmation of refund.

Once the 30 day refund guarantee period has expired the contract and payment plan are deemed fully active and the full payment of the fees for the annual package is mandated, regardless of whether the client participate further in the service/product/package.   

You agree to notify us by email in the event you become aware of any inappropriate behaviour or content being displayed on or in the Community Membership, within our private areas or associated groups, or within any of our associated social media channels.

By becoming a Member, you agree to conduct yourself in a reasonable and responsible manner when accessing the Community Membership, and any associated groups, and further you agree not to use the Community Membership or any other associated groups for any unlawful purpose and that you will not upload, post, transmit or otherwise make available any content that:

  1. infringes any Copyright, trademark, or other Intellectual Property rights belonging to us or any other person or entity;
  2. which is by its nature defamatory, libelous, obscene, demeaning or which causes offence to another individual whether intended or not;
  3. discloses personal and/or sensitive information about another person;
  4. is threatening or causes a Member to feel harassed or in fear;
  5. is classed as spam.

When accessing the Community Membership or our private Member areas, you agree not to take any action which seeks to disable or in any way interfere with any of our systems or processes or tests or seeks to test the vulnerability of any of our systems or processes.

By purchasing access to the Community Membership you hereby agree and undertake that from the date of purchase:

  1. not to infringe any of our or any other Member’s copyrights, patents, trademarks, trade secrets or other intellectual property rights;
  2. that any Confidential Information disclosed by us or any other Member is confidential and proprietary, and belongs solely and exclusively to the person disclosing it;
  3. not to disclose such Confidential Information to any other person or use it in any way other than as part of your Community Membership;
  4. the reproduction, distribution, and/or sale of any information or materials provided during provision of the Club Membership or at any time thereafter by anyone but us is strictly prohibited. 
  5. You agree that in the event of any breach of your obligations contained in this Agreement then damages, loss, or irreparable harm may arise and that in such circumstances we shall be entitled to seek relief, including injunctive relief against you.
  6. You agree to indemnify and hold us harmless for any action taken against us due to your violation or disregard of any of these Terms and Conditions and/or your participation in any way in the Club Membership.

The Fee for access to the Community Membership is as set out in the Prospectus (“The Membership Fee”) and payment of it shall be made without deduction, set off or any form of withholding except as is required by law.

At the end of your Membership Period, unless you notify us to the contrary your membership will be cancelled and your access removed. 

If the Member elects to pay by monthly, the Member authorises the Company to charge the Member’s credit card or debit card. 

If the Member elects to pay in FULL, the Member may pay by credit card, debit card or bank transfer.

We reserve our rights to terminate your access to the Membership Services, with immediate effect, if you:

  1. commit a material breach of your obligations under this Agreement; or
  2. fail to provide payment of any amount due in respect of the Membership Fee as and when it becomes due; or
  3. have a bankruptcy petition presented against you or you become subject to a bankruptcy order; or
  4. enter into a voluntary arrangement pursuant to the Insolvency Act 1986.

Access will be cancelled if more than 1 person is found using the product and a refund will be denied. If you would like to discuss a multi-person license of the product, please email [email protected].

Upon termination of this arrangement for any reason:

  1. all clauses which either expressly or by their nature relate to the period after the delivery of the Services or expiry or termination of the same shall remain in full force and effect; and
  2. you shall cease to use, either directly or indirectly any Confidential Information, and shall immediately return to us any documents in your possession or control which contain a record of any Confidential information.

By entering into this Agreement you acknowledge and agree that:

This Agreement does not constitute or imply any business relationship other than as set out within this Agreement.

The Community Membership is a group experience and any information, support and guidance you receive will not be personal to you and should not be taken or relied upon as advice, guidance or information personal to you.

You have not relied on any statement, promise or representation made or given by or on our behalf.

We make no guarantee, representation or warranty with respect to the Community Membership

To the maximum extent permitted by law, we shall not be liable (whether caused by us, our agents, employees or otherwise) to you for any indirect, consequential or special damages, losses or costs or any failure to deliver the Community Membership, any Sessions or any meet-up where we are prevented due to a reason behind our reasonable control;

In the event damages are incurred by you as a result of our default or breach of this Agreement, our entire liability under this Agreement is limited to the amount of the Membership Fee paid by you as at the time the loss is sustained.

Nothing in this Agreement shall limit or exclude our liability for death or personal injury caused by our negligence or for any fraudulent misrepresentation.

During the term of this Agreement and at any time thereafter, you agree to take no action which is intended, or would reasonably be expected, to harm us, our agents, employees, contractors, or clients, or our or their reputation or which would reasonably be expected to lead to unwanted or unfavourable publicity to us, our  agents, employees, contractors, or clients.

In the event any provision of this Agreement is deemed to be invalid, or unenforceable for any reason then that provision shall be struck out and the remaining provisions shall remain valid and enforceable.

This Agreement shall be governed by the exclusive jurisdiction of the Courts of England and Wales and the laws from time to time in force.

No modification or variation to this Agreement shall be effective unless in writing and signed by us both.

Save as provided for in clause f he Contracts (Rights of Third Parties) Act 1999 shall not apply.
